3.2.6: There is a clear and appropriate distinction, in writing and practice, between the policy-making functions of the governing board and the responsibility of the administration and faculty to administer and implement policy.
Narrative:
There is a clear distinction between The University of Texas (UT) System Board of Regents policy-making functions and UT Arlington’s responsibility to administer and implement policies. The policy-making function of the Board of Regents is outlined in Texas Education Code, Section 51.352, and states that the Board of Regents provides the policy direction for each institution of higher education under its management and control. [1] Evidence of the Board’s policy-making functions can be seen in the Board’s meeting minutes. Said minutes are available for public purview on the UT System Board of Regents website. [2]
UT Arlington abides by the UT System Rules and Regulations of the Board of Regents. Guidelines for the creation of Rules and Regulations are outlined in Series 10100, Rule on Rules and Regulations. [3] The UT System Rules and Regulations of the Board of Regents, Series 20201, Section 4, clearly states that each institution’s president, under the direction of the Executive Vice Chancellor, has the general authority and responsibility for the administration of that institution. [4] Chancellor authority is outlined in Series 20101, Chancellor. [5] Section 4 also outlines the various duties and responsibilities of university presidents. Duties include: (a) development and administration of policies and procedures, (b) nomination of faculty and staff, (c) preparation and submittal of governance rules and regulations and (d) development of long-range plans. Series 20201 is also noted in the UT Arlington Handbook of Operating Procedures (HOP), Section 2-101. [6] UT Arlington’s HOP is the administration’s avenue for the dissemination and implementation of UT Arlington rules, regulations and policies to all UT Arlington administrators/officers, faculty, staff and students. The HOP is compliant with the rules and regulations set forth in the: (a) UT System Rules and Regulations of the Board of Regents, (b) Texas Education Code and (c) Texas Higher Education Coordinating Board Rules.
HOP Section 1-102 notes that all UT Arlington employees must abide by the Rules and Regulations of the Board of Regents, the UT System and the HOP, along with all applicable federal and state regulations. [7] Section 1-201 of the HOP states that it is the responsibility of the President to distribute copies of the HOP and its amendments, [8] and Section 1-203 stresses that the President is the ultimate institutional authority regarding the interpretation and jurisdiction of the HOP. [9] Current copies of the HOP are housed in the Offices of the President, Vice Presidents, Deans and the University Library. The HOP is also available online. [10]
The HOP clearly outlines the roles/responsibilities of the various administrators (Subchapter 2-100) [11] and faculty members (Subchapter 3-200). [12] The Faculty Guide [13], UT System Rules and Regulations of the Board of Regents, Series 31004, [14] and HOP Sections 6-354 [15] and 6-501, [16] address academic freedom in the classroom and in research, and faculty rights and responsibilities as citizens and teachers.
