Comprehensive Standards 3.2.5 Governance and Administration

 Compliance        Partial Compliance        Non-Compliance

3.2.5: Members of the governing board can be dismissed only for cause and by due process.

Narrative:

The University of Texas (UT) System Board of Regents members can only be removed if the Texas Senate confirms a member’s impeachment. Texas Education Code, Section 65.11, states that the Governor, with the consent of the Senate, appoints the nine-member Board of Regents. [1] Article 16 of the Texas Constitution [2] states that Board members serve six-year staggered terms. While the UT System does not have a formal dismissal process for Board of Regents members, the Texas Constitution, Article 15, [3] clearly outlines public officer impeachment. According to Article 15, the Governor can remove an officer that he/she previously appointed provided that two-thirds of the Senate approves the action of impeachment.
