Comprehensive Standards 3.2.2.4 Legal Authority and Operating Control

 Compliance        Partial Compliance        Non-Compliance

3.2.2: The legal authority and operating control of the institution are clearly defined for the following areas within the institution’s governance structure:

Narrative:

3.2.2.4 related foundations (athletic, research, etc.) and other corporate entities whose primary purpose is to support the institution and/or its programs:

UT Arlington does not have any foundations or corporate entities. As evidence of this, UT Arlington provides a letter from the Institution’s Director of Internal Audit. [1] However, UT Arlington does have an Alumni Association that is a 501(c) 3 independent, nonprofit organization that was established for educational and charitable purposes. The Alumni Association’s mission is to promote a positive image of the University to the student body, alumni and community. [2] The Alumni Association is governed by a 40-member Board of Directors and the UT Arlington Alumni Association Constitution outlines the election/appointment process for Board members. [3]

Control of the Alumni Association (affairs, funds and property) is given to the Board of Directors. The Board of Directors is supported by six UT Arlington employees: the Alumni Association Executive Director and her staff of five. As evidenced by the UT Arlington Alumni Association Organizational Chart, [4] the Executive Director reports to the UT Arlington President and is also subject to Board direction and approval.

The land and facilities that house the Alumni Association are owned by the Alumni Association. Association budgets are approved by the Board of Directors and the UT Arlington President. The Alumni Association has an accountant and Board Finance Committee to handle Association finances. An accounting firm performs annual audits on the Association. As evidenced by the Board’s January 2006 meeting minutes [5] and the 2005 audit’s management letter, [6] no material weaknesses were found.
