3.2.14: The institution’s policies are clear concerning ownership of materials, compensation, copyright issues, and the use of revenue derived from the creation and production of all intellectual property. This (policy) applies to students, faculty, and staff. 

Narrative:

The University of Texas (UT) at Arlington has comprehensive intellectual property guidelines. UT Arlington clearly defines University rules, regulations, policies and procedures regarding intellectual property in its Intellectual Property Handbook. [1] This handbook applies to: (a) all persons employed by UT Arlington, (b) anyone using UT Arlington facilities under the supervision of UT Arlington personnel, (c) master’s and doctoral candidates and (d) pre- and postdoctoral fellows. The Intellectual Property Handbook policies and practices can also be found in UT Arlington’s Faculty Guide, [2] Handbook of Operating Procedures (HOP), [3] Graduate School Catalog, [4] Office of Research Administration website [5] and the UT System website. [6]

According to the Intellectual Property Handbook, intellectual property is defined as “any invention, discovery, technology, scientific or technological development, computer software or other form of expression that is in a tangible form. Intellectual property can be protected by patent, trademark or copyright laws...” [1] The procedures established by the Intellectual Property Handbook are in compliance with the UT System Board of Regents Rules and Regulations, Series 90000, Intellectual Property guidelines, and are intended to safeguard the UT System's interest in intellectual property without significantly impeding the free exchange of information or the right to publish. [7]

Under basic UT System policy, the ownership of intellectual property rights initially resides with the inventor, author or creator. If the intellectual property results from work done wholly on his or her own time and without any System support, the inventor, author or creator retains all rights of ownership.

When intellectual property results from work done on UT Arlington time, using UT Arlington facilities, or with any UT System support, any invention or discovery that the creator believes may be patentable must be submitted to the UT Arlington Intellectual Property Committee (IPC) for consideration. This University-wide standing committee is appointed by the President to: (a) review inventions/disclosures, (b) recommend disposition of invention, (c) act in an advisory capacity regarding intellectual property disputes, (d) assist in the education of research personnel regarding intellectual property awareness, (e) maintain a liaison in the Office of Grant and Contract Services to screen proposals submitted for extramural funding and (f) review intellectual property policies, and if need be, formulate recommendations for change. [3]

When the IPC believes that the University should pursue intellectual property interests, it recommends this to the President. If the President concurs, the intellectual property information is forwarded to legal counsel under contract with UT Arlington in order to secure patent protection. lf UT Arlington does not desire to utilize its interest in the intellectual property, whether by seeking patent protection or otherwise, the creator is notified and is thereafter free to deal with the intellectual property as he or she chooses. When UT Arlington desires to utilize its interest in the intellectual property, it is mandatory that the creator assign all rights to the Board of Regents for the UT System. Utilization by UT Arlington may or may not involve filing a patent application.

If emerging issues and disputes arise regarding intellectual property, the IPC reviews the issue or dispute and makes a recommendation to the Provost. The Provost determines whether to accept or reject the recommendation. If an appeal of the Provost’s decision is requested, the President will make a final decision.
